Default Question about intercession at the graveside
As-salamu alaikum wa rahmatullah.

I have a question for those scholars on this forum and those who can reliably transmit the opinion of scholars who advocate asking intercession directly from the Messenger () at his graveside.

Narrations exist that are used by advocates of this opinion, such as the narrations of al-Utbi and Malik al-Dar.

My question: can you name any Mujtahid Imam of the Righteous Salaf who used these narrations to justify this opinion of asking intercession directly from the Messenger () at his graveside?

He probably is referring to Imams of the first three generations, like the Imams of the 4 Madhahib, Imam Sufyan ath-Thawri , Imam al-Awza`i , etc.

We can go with the understanding that generation here refers to 100 years, so the first 300 years.

It wasnt even a issue of controversy back then. So you wouldnt find any such justifying prior to Ibn Taimia. But from biographical books we can read story's of them practicisng it

You should clarify this. By mujtahid meaning only the 4 imams and not those mujthahids who chose to work within the bounds of the madhab? Are you following the maliki madhab and you prefer opinion of this madhab?

In addition, Fatawa ‘Azizi of Mawlana Shah ‘Abd al-’Aziz Dahlawi contains the following question and answer: “Question. Is it correct or not to seek aid from the Prophets (may Allah grant them peace), the noble saints, the worthy martyrs and the lofty pious after their deaths, saying, ‘Oh such and such a person, request for me a need from the Almighty, intercede on my behalf, and pray for me’.

“Answer. To seek aid from the dead (istimdad) — regardless of whether this is done at the grave or away — is without a doubt a bid’ah, and did not exist in the time of the Companions and the Followers. However, there is a difference of opinion regarding which type of bid’ah this falls into. In that, is it a reprehensible bid’ah or a praiseworthy bid’ah, as a result the ruling would be different. Considering istimdad is of different types, if the seeking is of the type mentioned in the above question then it is clear this is permissible. This is because there is no shirk in this. This is the same as making requests for supplications and other needs from the pious in their life. If this (istimdad) is done in a different way then the ruling would accordingly be different.” (Fatawa ‘Azizi, 1:89)
