Default Maliki view of making images/pictures
Salaam 'aleikom,

Sorry if I posted this in the wrong section, wasn't sure if this was the right section.

I have read that the Hanafi, Hanbali and Shafi`i madhabs say that making pictures is prohibited. They based their arguments on many sahih ahadith from the Prophet(pbuh) which state that it is not allowed to make images.

I have read somewhere else that the Maliki madhab says that it is allowed to make 2d images.
My question is, is this true?
If it is, on what did they base their arguments that it is allowed to make images?
And how do they look at the numerous ahadith that report that the Prophet(pbuh) prohibited the making of images?

I am not talking about (digital) photography that we know in our time, cause I know there is disagreement between the scholars about this point. But I mean pictures/images drawn with the hand on paper, painting etc.

I am not a Maliki but the Maliki school is based on the actions of the people of Madinah with ahadeeth used as a supplementary source, not the primary source.

لا يجوز عمل التماثيل على صورة الإنسان أو شيء من الحيوان ولا استعمالها في شيء أصلا والمحرم من ذلك بالإجماع ما له قائم على صفة ما يحيى من الحيوان وما سوى ذلك من الرسوم في الحيطان أو الرقوم في الستور والبسط والوسائد ففيه أربعة أقوال المنع والجواز والكراهة واختصاص الجواز بما يمتهن كالبسط بخلاف الستور والمعلقة ويباح لعب الجواري بالصور الناقصة غير التامة الخلقة كالعظام التي ترسم فيها وجوه وقال أصبغ الذي يباح ما يسرع إليه البلى

in al-Qawanin al-Fiqhhiyyah it states:

It is the popular opinion in the Maliki school to differentiate between 2-D images of animate life which are placed up high on the wall and such images which are placed in places which are trampled upon (e.g. rugs) or sat on (e.g. sofa or pillow.) It is makruh to place such images in a position of respect such as on the wall for display and it is mubah to use such 2-D images in places which are trampled upon, sat on or not very prominent. (al-Qawanin al-Fiqhhiyyah: Kitab al-Jami `akhaaam ad-dawwad wa al-tasweer.)

This was posted on the Maliki fiqh group site on yahoo and I believe OmarHH did the translation. I can't seem to scan the Arabic from the copy I have but the translation is not literal but the meaning is sound.

Shokran brothers for the replies.

I have read the text ,that Ibn Abbas placed, before.
But that text goes about placing/having 2-D images of animate life in ur house, not about creating/drawing 2-D images of animate life.

Does this mean its allowed in the Maliki Madhab to draw/create these images?
Cause thats my question: Is it allowed to create/draw 2-D images of animate life, in the Maliki Madhab?

I hope you understand what I mean.
