Default Hajj with Zakat money permissible ?


There is an elderly couple who are struggling financially. The husband is a revert and they are good pious muslims. I would like to find out weather it is permissible to use zakat money to send this couple for hajj ?

I have read that it is not permissible to give zakat money to a person and specify what it should be used for.

Please advise

From what I learnt is that while giving zakat money to a needy person, we must give him a amount which doesn't make that needy person sahib-e-nisab i.e that person now has has become eligible to give zakat to others.

And in your question, given the situation it is not obligatory for those elderly couple to perform Hajj. If you want to help them to perform Hajj send them for Hajj-e-Badal i.e, Performing Hajj on behalf of others. But you can't send them to Hajj with zakat money because you cannot give one person a huge amount of zakat that the person himself is now eligible to give zakat to others.

Scholars correct me If I am wrong.

i think you need to get that checked. i did a quick google search and results are coming up that there is no limit to how much zakat is given to a person who is eligible for it........and as far as i know, you cannot dictate to the receiver how he spends that money. once he receives the zakat money then he becomes the owner of it and he can spend it however he likes.

why dont you just ask a local mufti?

Answer :

The obligation of zakkat will be fulfilled even if you give all your zakaat money to one person.

However, if zakkat will become fardh on the person who is taking zakaat due to the excess amount of money given to him, then that is mukrooh. (Fatawaa Rahemiyyah V. 2 P.13)

Alhamdulilah, Imam of my masjid is mufti from darul uloom deoband. He teaches me many things. He also taught me this topic. So the question of OP was very clear for me.

not sure what you are getting at.

are you saying that that the imam of your masjid differs with the fatwa that i posted above? did he say that it is not permissable and the obligation not fulfilled if a large amount of zakat is given to one person?

No brother, I am not saying this.

What Mufti sahib has taught me is to not to give an amount of Zakat to one person to an extent such that the person who receives zakat money becomes fardh for him to give Zakat.

So while giving zakat to one person we should also keep this point in our mind.

isnt that more or less what mufti desai was getting at, except that he clarified the matter further and explained why it should not be done like this (because it is makrooh) and also explained that if it is done like this then the obligation is still fulfilled.

Yes, the matter is same. But why to perform an action which is makrooh?

i understand what you are saying, but fatwas do need to be clarified.

what if a person has already given a big amount of zakaat money to someone. he then learns that this is not allowed without understanding the matter. he may then go on to think that he has done something completely contrary to the deen (something haraam) and may think that his zakaat has not been fulfilled. and then he may think that he has to give his zakaat again and so forth.
