Default Quick Reply needed- Qadha fast intention issue...
Assalamu 'alaikum wa rahmatullahi wa barakatuh,

A sister has asked me about her fast. She made du'aa to Allah yesterday night that she wants to keep both Qadha and Shawwal fast for today and to give her the taufeeq to wake up at suhoor. It so happens that she didn't. So she says she did gargle water but didn't feel anything go down the throat. In the morning she asked me if her fast was valid or not. She hasn't eaten, as far as I know the intention of the Ramadhan fast maybe kept until Zawwal time, so because it was before zawwal that we spoke I told her to renew her intention and not eat until I find out an answer for her. Is her fast valid?

Only for nafli (voluntary) fasting it is allowed to have an intention of fasting up until midday (islamically calculated). For fasting that is fard like make up fasting of Ramadan, it is necessary to have an intention before fajr saadiq. The fasting will not be correct if intention was made after fajr saadiq. See Ashraf al-Hidaya, volume 3, p. 195.

Also, it is not necessary to wake up at suhur in order to hold an obligatory fast. This is recommended only. You can have a solid intention to fast the night before you go to sleep without waking up before the beginning time of Fajr in order to eat.

JazakumAllahu khairan. So will her fast be valid? Also I read the intention issue in a book by a reputable mufti, so I am confused slightly...

It depends whether the night before she had the solid intention to fast. In which book from which Mufti? Can you quote the text?

Your Questions Answered by Shaykh Mufti Saiful Islam:

" Q: I forgot to make my niyyat during the night, but without breaking my fast I made the intention in the morning. Is my fast valid?

A: It is preferable to make the niyyat for the fast of Ramadhan during the night, i.e prior to the entry of subah sadiq (when the fast begins). If the intention was not made during the night , the fast will be valid if the intention was made before zawwal. The exact time limit for the validity of the intention for fasting is the time of Nisf-Nahar (midday)"

This is for Fard Ramadan fasting done in Ramadan (ada').
For Qada of Ramadan, it's necessary for the niyyah to be made the previous night before fajr, yet after Maghrib.

Seems a difference of opinion. Salafis dont allow it either. See fatwa of sh. al-munajjid.
