I wouldn’t have it any other way if a plane enters restricted airspace down it! If a vehicle enters a restricted road shoot to kill! I don’t know why anyone would start such a misleading thread (without a link) and I don’t like anyone playing mind games with me. Court martial the soldier? How about the person that started this thread? |

A solider ran after a minibus driving on a restricted road firing his machine gun.
Is it possible he thought it was a terrorist unit? Maybe. I don't know enough of the facts to say if this is a plausible explaination. But he killed a 95 year old woman. In violation of Israeli rules. Possibly in violation of any semblance of national defense. If so, I would advocate handing him over to the PA if I believed that they wouldn't torture and kill him without trial. But he needs to be arrested and tried, not just investigated. We MUST retain the moral high ground as much as possible, if not then we betray ourselves and our faith. |

Then there was no intent to kill and therefore there should be no charges. Can't see that myself, depends on Israeli laws and his specific orders. btw, aiming at the engine is not a good way to stop a vehicle, unless you want to blow it up. |

A palestinian vehicle was on a restricted road... of course they have every right to shoot first. The american gov would do the same thing in restricted areas. Today marks the 15,000 terrorist action by pals against Israelis in a 2 year period. The article went on to say that by the end of this coming summer, at this rate, attacks will have reached 20, 000!!!!!!!! Israel actually doesn't shoot enough. How many attacks would our government allow in our borders and for how long? What Israel puts up with is outrageous and no other place on earth would put up with what Israel is forced to do by the rules of the international community.

L@amplighter, in nearly all legal systems whether there was or was not an intent to commit a crime is usually only considered at the sentencing stage and it is pretty much inadmissable as a defence. I can tell you don't watch "The Practice". Intent certainly does matter in a trial and BEFORE sentencing. A person's intent may at times mitigate the charges and is always on the defense attorneys mind as a possibility in any defense |
