it's unfortunate he was even tried. IMO most traitors should be disappeared, drained of information, and liquidated.

The death penalty only applies to acts of treason, sedition or espionage in time of war as declared by the Congress, apart from Federal murder convictions. The biggest failure is that they didn't turn him. They should have turned him.
