UN inspectors were in the process of confirming compliance via a UN resolution to confirm compliance when Bush and his 'coalition of the willing' commenced the Iraq war. It wasn't argued whether or not Hussein ever had them...hell, everyone knows he used them and that's why he and some of his henchmen have been hanged by the Iraqis afterwards for doing so. He just didn't have them by the Iraq war.
