(中央社記者賴又嘉台北13日電)前總統陳水扁遭控利用金控併購向企業索賄及扁家洗錢案,台灣高等法院今天 二審宣判,扁從一審無罪,被改以貪污罪判刑18年,妻子吳淑珍被判刑11年。全案可上訴。

高院除判陳水扁18年外,併科罰金新台幣1億8000萬元,褫奪公權9年;吳淑珍除被判刑11年,併科罰金 1億200萬元,褫奪公權8年。

特偵組於民國98年12月以陳水扁、吳淑珍利用金控併購案,向國泰、元大兩家金控索賄新台幣6億餘元,起訴 扁珍貪污;國泰世華副董事長蔡鎮宇、元大馬家及扁家子女陳幸妤、陳致中、黃睿靚夫婦,被檢察官認為協助扁家 隱匿貪污所得,遭依洗錢罪起訴。

全案去年11月5日一審宣判,台北地院合議庭認為,金融合併案並非憲法列舉的總統權限,且難以認定國泰、元 大交付扁家款項時,有賄求之意,判扁、珍及所有被告無罪。1001013

二次金改弊案高院今天二審宣判,前總統陳水扁、吳淑珍夫婦被認定犯下貪污、洗錢罪,陳水扁兩罪合併判處十八 年,併科罰金一億八千萬元;吳淑珍合併為十一年,併科罰金一億兩百萬元。另外,扁家成員陳致中、黃睿靚夫婦 也被認定犯下洗錢罪,各處有期徒刑一年以及六個月,不法所得全部追繳沒收。全案可上訴。

二次金改案二審宣判,有部分被告被法官改判有罪,因為高院合議庭認為,我國憲法歷經七次修改,總統職權明顯 擴大,對於金融機購合併有實質影響力,所以,前總統陳水扁被認定犯下貪污、洗錢罪,兩罪合併為18年、併科 1.8億元罰金、褫奪公權9年。夫人吳淑珍也因貪污、洗錢罪,合併判刑11年、併科一億兩百萬元罰金、褫奪 公權8年。

辯護律師鄭文龍說,一定會再上訴。

至於洗錢部分,兒子陳致中被判1年、併科400萬罰金、兒媳黃睿靚被判6月、併科200萬罰金;吳淑珍的哥 哥吳景茂、陳俊英夫婦,因符合證人保護法,獲判免刑。至於前總統府辦公室主任馬永成,判刑8年、褫奪公權6 年;前元大集團總裁的兒子馬維建,被判8月、緩刑2年、支付國庫30萬元,前元大高層部分,杜麗萍被判3月 ,緩刑2年,支付國庫20萬元。而其它金控業者全部維持一審的無罪判決。

The corrupt bastard have only one ass to sit in the cell and already got life sentence. So 10 more extra sentences will also be redundant exercise. Yet his Treason charge on legal action demanding USA to exercise sovereignty & occupational control on Taiwan is still hanging. Should had sentence him death for treason and shoot him for once and for all rather than proceeding with these little games.

TAIPEI, Taiwan (AP) — Taiwan's former President Chen Shui-bian has received a new 18-year prison sentence on top of the 17 years he is already serving for corruption.

However, a court spokesman said his total time in prison cannot exceed 30 years.

The High Court on Thursday overturned a lower court's acquittal and said Chen took $20 million worth of bribes from two banks in separate merger cases during his 2000-2008 presidency.

The lower court did not regard the money as bribes, noting the president has no say on mergers.

The 61-year-old Chen can appeal the latest ruling.

The main part of Chen's sentence was handed down in September 2009. It relates to his conviction on charges of accepting some $9 million in bribes.

TAIPEI — Taiwan's ex-leader Chen Shui-bian -- who is already in jail for corruption -- was given an additional 18-year sentence on Thursday for his role in a financial scandal, a high court spokesman said.

Chen, who was president between 2000 and 2008, is already serving a jail term of 17 years and six months on two bribery convictions in sprawling corruption cases that saw his wife Wu Shu-chen get the same sentence.

In a separate financial case, a district court cleared Chen and his wife last year of accepting bribes to facilitate two high-profile bank mergers, citing lack of evidence.

But the high court on Thursday reversed the lower court's verdict, finding Chen guilty of abusing "his influence as president" and accepting bribes from the banks to facilitate the mergers, a spokesman said.

The high court sentenced him to 18 years in prison, he added.

The wheelchair-bound Wu -- who is paralysed from the waist down and has been spared from serving previous sentences due to poor health -- was also given a 11-year sentence in the same case.

The couple is expected to appeal the ruling.

Chen and family members have been accused in a complex network of cases that say they sent political donations and secret diplomatic funds abroad, laundered millions of US dollars and took kickbacks on government contracts.

Chen is the first former Taiwanese president to stand trial, which has been watched with intense interest by the island of 23 million, but it has also triggered disillusion with politics in the young democracy.

Chen, who favours the island's independence from China, has dismissed the legal action against him as a political vendetta by the Beijing-friendly government of his successor Ma Ying-jeou.

But he has admitted that his wife wired some of his political donations abroad without his prior knowledge and apologised.

How come he never fled the country? If I was him I would have made the opportunity to run ASAP than dont have to go jail, with that much corrupt money he has, many places he can run to..

How come he never fled the country? If I was him I would have made the opportunity to run ASAP than dont have to go jail, with that much corrupt money he has, many places he can run to..
Any country that sheltered him may face big shit from PRC.
