-The ruling was not unexpected because of the events after the May 3 ruling in which Judge Gordon Thompson Jr. moved to enforce an order he initially made in 1991. He told the city to move the cross because it violated the state constitution's ban on government aid and preference for religion.

Commentary: After decades of atheist and A.C.L.U. efforts and millions of there dollars, case dismissed.
The anti-Christian who brought the suit is dead and the suit against San Diego doesn’t apply because they don’t own the land.
The guy should have bought a jet ski instead. He wasted his whole meaningless miserable life. (More so then other moonbats.)

Unfortunately, it was an appeal by the city of San Diego that was dismissed.

A federal appeals court dismissed the city of San Diego's appeal yesterday of a now-irrelevant $5,000 per day fine imposed by a federal judge in May in the legal fight over the Mount Soledad cross.

In a brief ruling, a three-judge panel of the 9th U.S. Circuit Court of Appeals said the city's appeal was moot because it no longer controls the land that the La Jolla landmark sits atop. The battle over the cross continues. Two lawsuits challenging the land transfer are pending in federal court. Key hearings and a potential trial in those cases are now scheduled for July. Nuts. They're going to fight over the transfer of the land to the federal government last summer. IMO, they should just leave it alone.

The A.C.L.U. usually pulls in over 6 figures per attorney. If they lose they fall back on contributions.

I think it's kinda' funny that a thread about a cross is put in the politics section. Conservatives always get pretty defensive when someone says they try to inject their religion into politics, yet, here ya' go.

As for the cross, this fight has been going on for some time and, while the cross will (rightfully) remain there for the foreseeable future, it will likely always be contested...

As is your wont Hank you have completely misread this piece of news. It has been pointed out here many times before that this case has moved to federal court as a result of the city transferring ownership. And I'm not sure which appelant you're talking about but one of them is a Jewish veterans group wich is decidedly not dead.

I will once again point out to you that many many christians in this country support enforcement of the establishment clause. My priest is one.
