Default Why Roberts "did the right thing"
There were concerns that his Court was being referred to as "the Kennedy Court" because that justice had so much influence on all their recent lousy rulings, the latest one excepted .

Also, he said during his confirmation hearings that a good judge was supposed to be merely an umpire and not to legislate from the bench. godbless him

Did Chief Justice Roberts save the Supreme Court?

All these rumors about pressure being applied to Roberts?

Guarantee you it was Republican, establishment types..

What happened is they pressured him to hand a backhanded win to Obama and weaken the commerce clause in the process. (It is being abused)

It was supposed to unite voters behind and force Obama to defend this turkey 4 square, right through the election..

If Roberts voted it down, Obama could campaign on all the "good stuff" people lost, scream racism and activist court and there was a concern it would alienate independents and make the GOP look partisan, petty and mean.

Basically the narrative following the 2000 recount scandal.

i also heard about the commerce clause being weakened in the long-run too, benefitting conservatives.

as to his judicial philosophy, he said in his conf hearings:
http://news.yahoo.com/blogs/power-pl...0.html#more-id
"Judges are like umpires. Umpires don't make the rules; they apply them," said Roberts at the time. "The role of an umpire and a judge is critical. They make sure everybody plays by the rules, but it is a limited role. Nobody ever went to a ballgame to see the umpire." they don't decide whether the reasoning behind a law is good, rather they decide if the law is constitutional given the laws intent

Well, he did.. He re-wrote the law twice in this ruling.

He WANTED to pass it.. The reason is to keep it alive and tape it to Obama.

I don't buy that Roberts is whacked out on drugs or that anyone actually believes this is constitutional..

Especially as written.

No Way.

it helps the right in the long-run considering narrowing the scope of the commerce clause. Obama may have won the battle but the establishment right/corps could win the war.

No.. There's now a new precedent. that there is NO LIMIT to the taxing power of the Federal government.. Up to and including the ability to compel economic activity.

"You want to buy a house?"

"No.. "

"Okay, the tax on that will be $12,000.00"

And the commerce clause is already so elastic that there's little concern about curtailing that with this ruling.

It's only a 'Conservative' win if you consider the 'Conservatives' to be really right-wing Progressives, because this is clearly a win for the Progressives.
