For several reasons - more specifically the due process clause, which pretty much grants the federal government/judges to rule in totalitarian fashion outside of legislators and grants the federal government unlimited powers, not to mention contradicts the Tenth Amendment.

The Fourteenth Amendment is exactly what grants the power to judges to rule however they see fit, more specifically the 9th circuit. i.e "activist" judges.

Very dangerous. It opens a Pandoras Box of tyranny..
