You shouldn't really have to **** around with process and memory usage to get an acceptable battery life out of a phone. I'd give it a few more charge cycles then take it back if it's still crap.
You say that, but that's exactly what you had to do on the iPhone 3G.

A smartphone is a computer. A computer often gets a memory hogging app stuck. Should I take my computer back because a third party app keeps the processor working long after it should?
