But i smell a rat? I first thought upon the initial story the batterys exploded, but that was left in tact!

It's strange that's for sure. There are millions of these things out there right, I suspect it would happen a lot more if it was indeed the Lithium-Ion battery then again but who really knows. They'll investigate and we'll find out.

This bit "Mr Embry said he started to panic and drove himself to a local elementary school where his wife work so she could take pictures of his injuries." is suspicious, IMO.
Most people who supposedly had something explode 'in' their ear would be more interested in seeking medical attention, rather than having pictures taken of it. I would also have expected her to have urged he had medical attention, rather than muck around with pictures.

I smell a scam. The condition of the phone looks like it never exploded. It's simply cracked. If something were to cause that much injury to your face then you would pretty much have no phone. Oh look the pictures are blurry too; unacceptable in 2010.

For the injuries to have occurred, there needed to have been some kind of projectile emanating from the phone itself.

Seeing that no part of the phone is missing, and no part of the glass protruding, I don't see how it could have caused those injuries even if it had exploded.

looking at the phone and were the "impact" was it looks like it came from the ear speaker. right behind the slot in the glass. speakers use a copper winding that moves the diaphragm to produce sound. a copper winding is basically a capacitor. so i wounder is it over volted and caused it to try and shoot the diaphragm out of the unit. just speculation mind you.. and the speakers are so tiny one wonders if it would be possible.
That kind of manufacturing defect could certainly blow up Motorola's legal defense.

I agree but my mate has exactly same phone and questioned the fact the cover to the speaker would be visible where its blown outwards.
Its hard to pass judgement on that from photo, but i still think iffy?

I'm 100% certain that a examination of the phone can, and will, determine if indeed it did explode in to his face/ear. Until then, I'll hold my thoughts..
