actually no...the three of us played pass the contract

I know this certainly voids the contract, but... it could also lead to forgery problems, thus, i am just curious if him not seeing it signed but signing saying he did voids it 1st.

It's more likely to land whoever signed it, and whoever witnessed it, in hot water. I assume the witness was a notary. If they are they'll end up paying a fine.

As for getting out of the contract, that all depends. The other party could take it to court, and then the judge will make the decision.

Depending on the judge and the story of the people who passed the contract around, yes.


Though a lawyer and judge will have to help make the final decision. As well, you better hope whoever the contact was passed around too all have the same stories.

Depends.

Some jurisdictions don't really care, others do.

It's much like verbal contracts. Some jurisdictions view them as legit, others do not. So it just depends.

Generally what happens is you have the burden of proof in proving that you didn't sign the contract and the person who "witnessed" you signing it really didn't see you sign it.
