The short answer to your question is no, unless he/she openly preaches anti-Islamic propaganda.

If you wonder the wisdom behind the punishment for an apostasy within Muslim lands ruled with true Sharia laws you might have a glance at this. Please note that today there isn't any true Islamic state.
