Most of us know that our breed of choice is not allowed at many rental properties so with that knowledge to make my life easier I prefer to disclose up front because moving sucks and this situation sucks for them and it could have been avoided possibly.

You're right, and I agree with you. But that is not a legal obligation, so it has no bearing on whether or not this guy can breach the contract. If he has an issue with a certain type of dog, he better know his stuff before he starts drafting legal contracts. A simple clause stating that the tenants will be held responsible for any additional costs incurred by their animals would have saved his ass...it's not just pit bulls that can affect insurance rates.

Did the renters bring their dog to the landlord to meet? If so, the landlord would know right away what the dog was regardless of if he knew AmStaff = pit bull type or not.

I see several people saying their dog is an "American Staffordshire Terrier" or "Patterdale/Bulldog cross" when it is, quite clearly, an APBT (and the prospective rental says "no pit bulls." They are the same folks that complain when they're being evicted.

Before passing any judgment on either parties, I'd like to know what Galadriel said. If the landlord said "no pit bulls" or "no pit bull type dogs," and the owners claimed the dog was "an AmStaff...not a pit bull," then the renters are in the wrong. If the landlord didn't have such a clause anywhere, then the landlord is in the wrong. HOWEVER, the landlord would have to be legally able to rent to them in the first place (zoning, HOA, homeowner's insurance, etc.) instead of just renting on the fly.

I was under the impression that there was nothing about breed on the landlords side but the renters requested in writing that their dog was allowed to be there with the prior history of finding a place to rent. But again I do not have that info. That was just the impression I was under. I do know he saw the dog prior to them moving in.

Again though if you restrict breeds you will have a list of breeds you don't allow. I personally have never run into a situation where when pit bulls weren't allowed where they didn't have a long list of "pit bull breeds" to rattle off to cover all bases and make sure there was no issues. But that is just my experience. Infact I've got the list from where I live right here and my previous residence.

My thinking is if you restrict breeds you know what breeds you are restricting.

Here is our previous pet policy: (I love how on the first one the weight limit is 25lbs but they have dogs larger than 25lbs listed as restricted. Not that you would have them there anyway if they were larger than 25lbs)

We allow cats and small dogs up to 25lbs(Full-Grown). Breed restrictions include: Pit Bull, American Staffordshire Terrier, Staffordshire Bull Terrier, Bull Terrier, Cane Corso, American Bull Dog, Boxer, Great Dane, Doberman, Rottweiler, Chow, German Shepard, reptiles, or pot belly pigs. Limit two pets per apartment home! Pet fee $300 per pet or $500 for two and $20 pet rent per pet. Pet photo and vaccination records due prior to move-in.

Here is our Current one: 2 pets allowed No weight limit but breed restrictions include: Akita, Chow Chow, German Shepherd, Doberman Pinscher, Rottweiler, Boxer, Alaskan Malamute, Pit Bull or Pit Bull type dogs including the American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, Bull Terrier, and American Bulldog. $300 for one pet and $150 for each additional pet.



I'm not sure how a private landlord would do it.
