Legislative intent is ruled on by the SCOTUS.
Well, here I agree, that it is the duty of the SCOTUS ___ to defend this Constitution. But the case you referred to offers no documented evidence as to the legislative intent of the 14th Amendment which supports its opinion. What the SCOTUS did, as was also done in the KELO decision, was fabricate an opinion unsubstantiated by the words of those who framed and ratified the Constitution, and to this degree is a subjugation of our written Constitution, and not an adherence to its legislative intent.

As to what is to be done with "THE CHILDREN", a catchy tactic used by many who wish to subjugate our Constitutional system, I answered that question above. But if you perfer another answer, I would image children of those who commit a crime and are incarcerated, under existing case law, are either ordered by the court to be placed in the hands of relatives or taken into custody by the state.

BTW, I never presumed to know what you think, or that you are "dead wrong" for something I presumed you think, but for the record, “if” [the operative word] you thought the Congress of the united States is concerned with protecting the health and safety of the American people from illegal aliens carrying deadly communicable diseases ( SEE The Dark Side Of Illegal Immigration___ Facts, Figures And Statistics On Illegal Immigration ) you are flat wrong!

Zippy, we have a very real problem staring us in the face being created by Congress. This is not a good time to ignore the clear and present danger which S. 1348 proposes to create.
